INTRODUCTION.
This file, REGISTER.CAL, contains Personal Calendar registration information,
fees, ordering instructions and form, and the software license agreement at the
end of this file. You can print this file by COPYing it to your printer with
the following DOS command:
COPY REGISTER.CAL PRN
The file already contains form feeds at a page spacing of approximately 57
vertical lines, therefore it is not advisable to use a program that formats the
pages. For additional information on Personal Calendar's operation and
features, see the README.DOC file contained in the archive, and the Help Text
within the program itself.

I place recent and major upgrades on these boards, and when released, they are
available there for download. I also post on CompuServe in the IBMSYS and
MSLANG forums, and in PCMagNet in the UTILFORUM.
SHAREWARE REGISTRATION AND FEES.
30-DAY EVALUATION PERIOD IS FREE.
You may use Personal Calendar for the first 30 days free of charge. After this
30-day evaluation period, if you decide you would like to continue using it,
you must register it with me. Fill out and return the ORDER FORM and a signed
copy of the SOFTWARE LICENSE.
REGISTRATION FEE.
The single user (personal license) fee is $25 for the program, plus shipping
and applicable sales tax. Personal, site and corporate licenses are available
as shown in the fee table in the ORDER FORM. If you desire to retain the
source code, there is an additional $25 fee. If you register the source code,
the fee allows you to use the code for educational purposes and to ask me
questions about its design and programming techniques which you might wish to
employ in your own programs.
Registration is to be paid by check or money order to the address shown.
Please specify 5-1/4" or 3-1/2" diskettes.
REGISTRATION VALIDATION FILE.
After I receive your registration, I will send you a diskette with the latest
copy of the program as a self-extracting archive, along with your personal
encoded registration information in a data file called CALSER.DAT. This file
is to be copied from the diskette to the directory from which you run the
program, and must be retained by you to be used with all future versions of PC.
SOFTWARE FORMATS, OWNERSHIP AND COPYRIGHT.
Both Shareware and registered copies of Personal Calendar are Copyright (c)
1985-1990, Paul Muñoz-Colman, do not constitute "free" or "public domain"
software, are owned exclusively by me, and are protected by U.S. and
international copyright laws and treaties. Personal Calendar is distributed in
two forms:
. A "Shareware" or "unregistered" copy of Personal Calendar is a copy
distributed on diskette or via an electronic bulletin board, on-line service,
or other electronic means, obtained from a Shareware disk vendor, or obtained
from another individual, and which displays the legend "Shareware" in the
startup and shutdown screens. If you obtained Personal Calendar bearing this
startup legend, you have an unregistered copy, which you may try out for 30
days without charge. After this time is up, you must register and pay for
Personal Calendar to continue using it.
. A "registered" or "licensed" copy of Personal Calendar is a copy which you
receive on a diskette that I send you, and which displays your name and a
serial number in the startup and shutdown screens, as well as on the diskette
label. Registered copies of Personal Calendar are distributed to those who have
purchased them. Your registered copy may only be used on the number of
computer systems according to the type of license you pay for, under the terms
and conditions specified in the license agreement contained in this file.
This method of distribution is known as Shareware. It allows you to determine
whether Personal Calendar meets your needs before you pay for it.
USE OF PERSONAL CALENDAR.
As with any TSR, Personal Calendar is a powerful program. While I have built
in extensive and reasonable safeguards, if you do not use Personal Calendar
according to the Help Text instructions, restrictions, and limitations, unusual
circumstances might cause you to damage to your computer software and data.
You assume full responsibility for the selection and use of Personal Calendar
to achieve your intended results. As stated below, my responsibility extends
only to replacement of a defective program diskette, per the terms and
conditions of your license.
LIMITED WARRANTY.
I warrant to owners of registered copies of Personal Calendar that the software
will operate in accordance with the description given in the Help Text
documentation, and that the diskette will be free of physical defects which
interfere with normal use. For a period of 30 days from the date of your
purchase of Personal Calendar, I will, at my sole option and subject to the
restrictions above and below, repair or replace any defective item(s), or
refund the purchase price of any diskette of Personal Calendar found to be
defective, if such defect is my fault and not the result of misuse or abuse.
Such a refund, repair, or replacement shall be your sole remedy for any
defects, program error(s), or documentation error(s). In no event shall I be
responsible for any other costs or damages whatsoever due to errors in usage or
your failure to read, understand, or follow instructions in the documentation.
I make NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION
THE WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE. My
warranty is expressly limited to the cost of replacement of any defective
diskette.
Suitability: if you are dissatisfied with a registered copy of Personal
Calendar for any reason (whether or not you find a software error or defect),
you may return the entire package at your own expense at any time up to 30 days
after purchase for a refund of your original registration fee. In so doing,
you must certify in writing that all copies of the CALSER.DAT file have been
permanently destroyed.
USE OF ONE COPY ON TWO COMPUTERS.
If you have a registered copy of Personal Calendar which is licensed for use on
a single computer, you may install it on two computers used at two different
locations (for example, at work and at home), provided there is no possibility
that the two computers will be in use at the same time, and provided that you
yourself have purchased Personal Calendar, or if Personal Calendar was
purchased by your employer, that you have your employer's explicit permission
to install Personal Calendar on two systems. The right to install one copy of
Personal Calendar on two computers is limited to copies originally licensed for
use on a single computer, and may not be used to expand the number of systems
covered under a multi-system license.
USE OF PERSONAL CALENDAR ON MULTIPLE SYSTEMS.
You may install your registered copy of Personal Calendar on a computer
attached to a network, or remove it from one computer and install it on a
different one, provided there is no possibility that your copy will be used by
more users than it is licensed for, either by site or by corporation. A "user"
is defined as one keyboard which is connected to a computer on which Personal
Calendar is installed, regardless of whether or not the user of the keyboard is
aware of the installation or use of Personal Calendar in the system.
SOFTWARE COPIES AND DISTRIBUTION.
Without prior approval by me, you may copy either the Shareware or registered
versions of Personal Calendar for normal backup purposes, and you may give
copies of the Shareware version to other individuals, which they may also use
and copy subject to the terms of this agreement. If you copy the Shareware
version of Personal Calendar for others, you must do it in the form of the
original compressed archive. You may not give copies of the registered version
to any person not explicitly covered by your software license. Distribution of
the program does not constitute sale or license for use; to use the program
past the 30-day free evaluation period, Shareware registration is required.
BBS SYSOPS. I explicitly permit the Shareware version of Personal Calendar
to be uploaded to and downloaded from BBS systems, including those who allow
downloads for a fee. This permission does NOT pertain to the registered
version. If you have any question as to whether the version which has been
uploaded to your BBS is Shareware, simply uncompress the Personal Calendar
archive and look for the file CALSER.DAT. If it is there, you have received a
registered copy which is not legal for posting; in this case run the program,
contact me and report the name and serial number which shows on the startup or
shutdown screen. If CALSER.DAT is not there, you have received a Shareware
copy which is legal for posting, as long as the list of file sizes, names, and
date/times match that in the README.DOC file.
DISK VENDORS. My policy on distribution of Personal Calendar by disk
vendors is the same for both commercial vendors and non-profit user group
libraries. I require that you obtain written permission from me before placing
Personal Calendar in any user group or commercial library. I will be pleased
to work with you in the distribution of my product, as disk vendors are an
important part of the Shareware distribution system. I will do my best to keep
you up to date with the latest version. Before I can send you a copy of
Personal Calendar and give you permission to distribute it I require that you
meet the following condition:
Send me a copy of your standard written materials (catalogs or
flyers) which clearly explain the Shareware concept, the need for
users to register products they use, and the fact that the price of
your disks is a copying fee only and does not constitute payment for
the product. The material must also differentiate between Shareware
and public domain software. Regardless of your language or the level
of detail, it must explain these basic concepts for me to be
confident that users are fully informed about what they are (and are
not) purchasing. It is not sufficient to state that you explain
these issues to customers in person, it must be reflected in your
written materials.

PERSONAL CALENDAR
NON-EXCLUSIVE SOFTWARE LICENSE
This AGREEMENT is entered into this _____ day of _______, 19___, by and between
Paul Muñoz-Colman, an individual, 11645 Charter Oak Ct., #201, Reston VA 22090,
hereinafter referred to as VENDOR, and _______________________________________,
located at ____________________________________________________________________
hereinafter referred to as CUSTOMER, agree as follows:
1.0 LICENSE TO USE VENDOR'S PROGRAM
1.1 VENDOR, for the consideration named, hereby grants to CUSTOMER a
non-exclusive LICENSE to use the proprietary computer program called Personal
Calendar ("SOFTWARE").
1.2 CUSTOMER shall pay VENDOR a one-time fee of ___________________
Dollars ($__________) for the LICENSE to use this SOFTWARE.
1.3a In the case of a personal LICENSE, VENDOR grants to CUSTOMER the
right to copy the SOFTWARE onto diskettes, hard disks, or in whatever manner
may be deemed necessary to archive, use, and cause the SOFTWARE to be active on
no more than one computer system at a time.
1.3b In the case of a site or corporate LICENSE, VENDOR grants to
CUSTOMER the right to copy the SOFTWARE onto diskettes, hard disks, or in
whatever manner may be deemed necessary to archive, distribute and use the
SOFTWARE within the site or corporation, including use on desktop computers.
For the purposes if this SOFTWARE LICENSE, "site" is defined as a single
geographic location (address) within a named organization or business.
"Corporate" is defined as all geographic locations within a named organization
or business.
1.4 VENDOR shall supply the latest verion of the SOFTWARE to CUSTOMER
which includes a customized specially encoded registration validation data file
CALSER.DAT. This file, when present in the directory in which the SOFTWARE
operates, will cause the SOFTWARE to operate in the registered mode and to
display the statement "Registered to:", CUSTOMER's name as declared on the
ORDER FORM, and the serial number of the program. Within the limits of LICENSE
per 1.3a or 1.3b, the CUSTOMER shall have the right to copy, duplicate,
distribute, and use the SOFTWARE on personal computers for the internal
purposes of the CUSTOMER.
1.5 This right to copy and reproduce extends to any material and
documentation supplied by VENDOR and related to the SOFTWARE.
2.0 TITLE TO SOFTWARE
2.1 Title and copyright to the SOFTWARE and all related material is with
VENDOR.
2.2 Neither the SOFTWARE nor this Contract may be assigned, sub-licensed
or otherwise transferred by CUSTOMER without the prior written consent of the
VENDOR.
2.3 CUSTOMER agrees to use its best efforts to prevent any and all
unauthorized persons from acquiring the registration validation data file
CALSER.DAT, and will exercise the same care and diligence to protect the
VENDOR's proprietary property as it does to protect its own.
3.0 TERMS OF AGREEMENT
3.1 The term of this AGREEMENT shall begin on the date of this LICENSE
and shall continue in perpetuity unless earlier terminated as described below.
3.2 VENDOR may terminate this AGREEMENT on ten (10) days written notice
to CUSTOMER if CUSTOMER fails to comply with the terms and conditions herein.
3.3 CUSTOMER may terminate this AGREEMENT on five (5) days written notice
any time during the thirty (30) day period following execution by both parties
and in such case, upon return of all SOFTWARE diskettes at CUSTOMER's expense,
shall receive a refund of the license fee paid.
3.4 After the thirty (30) days following execution, CUSTOMER may
terminate this AGREEMENT at its sole option at any time on thirty (30) days
written notice to VENDOR, and upon return of all SOFTWARE diskettes at
CUSTOMER's expense. No refund applies.
4.0 DISPOSITION OF SOFTWARE
4.1 If this Contract is terminated early, CUSTOMER shall return or
destroy all copies of SOFTWARE.
4.2 Within thirty (30) days after early termination of this AGREEMENT,
CUSTOMER shall verify by letter to VENDOR that the original and all copies of
the SOFTWARE, in whatever form, have been returned to VENDOR or have been
destroyed.
5.0 LIMITATIONS OF LIABILITY
5.1 VENDOR supplies no warranty with respect to the LICENSEd program
other than that stated herein. The obligations of VENDOR shall be:
5.1.1 To make a reasonable effort to fix any operations/execution
problems that are found by the CUSTOMER which prevent the program from
performing the functions described in VENDOR-supplied documentation.
5.1.2 To make available to the CUSTOMER a place where future
updates to the program for a period of ONE YEAR may be obtained by electronic
download to and by CUSTOMER's computer at CUSTOMER's expense, for no
additional fee.
5.2 The foregoing warranties are in lieu of all other warranties
expressed or implied, including, but not limited to, the implied warranties of
merchantability and fitness for a particular purpose. CUSTOMER further agrees
that VENDOR shall not be liable for any lost profits, or for any claim or
demand against CUSTOMER by any other party, except as provided herein. In no
event shall VENDOR be liable for consequential damages, even if VENDOR has been
advised of the possibility of such damages. VENDOR agrees that the CUSTOMER
shall not be liable for any lost profits for the unauthorized use or
distribution of the program so long as the terms of this AGREEMENT are complied
with.
6.0 LAWS GOVERNING
6.1 Regardless of the place of contracting, place of performance, or
otherwise, this Contract, and all amendments, modifications, alterations, or
supplements thereto, shall be governed by the laws of the Commonwealth of
Virginia, as to the nature, validity, and interpretation thereof.
IN WITNESS WHEREOF the parties hereto have caused this AGREEMENT to be
duly executed on their behalf as of the day and year first written in the
preamble of this AGREEMENT in two counterparts, each one of which bearing
original signatures shall for all purposes be deemed an original.
